Can I Keep My Engagement Ring?

Ending a relationship is never easy, and after a less than amicable breakup, it’s not always clear who the rightful owner of the engagement ring may be.


Florida courts are among the majority of jurisdictions that consider an engagement ring a “conditional gift” Meaning, the gift of the ring is conditioned upon the happening of marriage. Thus, if the marriage does not happen, the condition of the gift is not met, and ring is to be returned.


But, what if your ex never asked for it back? Well, that doesn’t necessarily mean he or she cannot still request for it to be returned. In Florida, actions for personal property have a statute of limitations period of four years. This means that your former fiancé may have entitlement to seek a return of the ring for a period of four years after the break up.
